(Frankfort - June 12, 2008) State Auditor Crit Luallen today released the fiscal year 2006-2007 Title VI compliance audit of state government agencies that receive federal funds and must comply with state law by submitting Title VI reports and implementation plan updates to the Auditor’s Office and the Human Rights Commission by July 1 of each year.

Title VI of the Federal Civil Rights Act of 1964 prohibits any state agency receiving federal funds from denying access to a program on the basis of race, color or national origin.

In reviewing the plans, auditors found 24 of the 26 agencies had complied with state law and submitted a plan. Last year all agencies submitted plans before the deadline.

Kentucky Vehicle Enforcement and the Department of Corrections, both within the Justice and Public Safety Cabinet, did not submit plans, and the Kentucky Commerce Cabinet and Kentucky Educational Television (KET) submitted plans after the July 1, 2007 deadline.

Kentucky lawmakers in 1994 established the Title VI reporting requirements. The Auditor’s Office sends its findings to the governor, the Legislative Research Commission, the Human Rights Commission and each state agency, as well as to the federal government for review. An agency's failure to submit a Title VI report and implementation plan could possibly result in a loss of federal funds.

Auditors tested the 24 agencies that submitted Title VI plans for 13 compliance requirements. Of the 312 total compliance requirements from all the agencies, there were 63 instances of non-compliance, for a 20 percent non-compliance rate.

This is a slight increase in the number of exceptions from the previous year; however, 40 of the 63 exceptions were noted in one cabinet, the Justice and Public Safety Cabinet. With the exception of this cabinet, compliance with Title VI reporting actually improved, according to the report.

The Auditor’s Office, in conjunction with the Commission on Human Rights, conducts Title VI compliance training for all of state government.
