(Frankfort - February 14, 2003) State Auditor Ed Hatchett released the seventh annual Title VI Compliance Audit of state government agencies receiving federal funds, which reports continued improvement in compliance with civil rights laws. This year’s noncompliance rate is 3.98%, which is down from last year’s noncompliance rate of 5.04%.

State agencies receiving federal funds are required to submit Title VI compliance implementation plans to Auditor Hatchett’s office, as well as the Human Rights Commission, by July 1 of each year. Twenty-nine agencies submitted updated plans. The plans were audited for compliance with 13 requirements, six (6) of which must be updated annually.

The report cites 15 noncompliance issues among the 29 agencies. The fifteen noncompliances fall within the six (6) requirements that are to be updated annually. The noncompliances occurred in the following agencies: Department for Local Government, Department of Military Affairs, Education, Arts and Humanities Cabinet, Kentucky Transportation Cabinet, Crime Victims Compensation Board, Department of Public Advocacy, and Kentucky Tourism Development Cabinet.

Title VI prohibits any state agency receiving federal funds from denying access to a program on the basis of race, color, or national origin.

“We are delighted to be able to report some good news about the progress our state is making in compliance with Title VI requirements,” said Hatchett. “We hope this trend continues until we become and remain 100% compliant with all civil rights laws.”
